I understand that I am submitting to Aubrey M. Horton (hereinafter referred to as "A.M.H.") the attached material (hereinafter referred to as the "material") for his evaluation per the following express understanding and conditions.

1. I am paying A.M.H. an evaluation fee of $38 -- to evaluate the material and quote a doctoring fee. I am aware that this $38 evaluation fee does not obligate A.M.H. to perform any editing, doctoring, or consulting in regards to the material submitted. I understand that my $38 evaluation fee only covers the cost for him to review the material and quote a doctoring fee.

2. I agree that I am voluntarily submitting such material to A.M.H. at my request. I understand that if I agree to a doctoring fee, that I will be required to pay such a fee in advance before any work will be performed by A.M.H.

3. I also understand that if a doctoring fee is paid, A.M.H. will edit the material -- which will involve script notations and suggestions -- to be decided upon by him.

4. I understand that A.M.H. shall have no obligation to me in any respect whatsoever with regard to such material once he has edited the material. I agree that if the material is lost in the mail, I will not hold A.M.H. at fault.

5. I understand that if such material submitted hereunder is not new or novel, or was not originated by me, or if because other persons have heretofore submitted or hereafter submit similar or identical material which A.M.H. has the right to use, then I agree that he shall not be liable to me for the use of such material, and he shall not be obligated in any respect whatsoever to compensate me for such use by him.

I acknowledge that but for my agreement to the above terms and conditions, A.M.H. would not accede to my request to receive and evaluate the said material that I am submitting to him herewith.
